Terms and conditions

Reservation, payment, cancellation, liability, security and conditions applicable to KSE services.

To be absolutely validated by a lawyer before final publication. These General Terms and Conditions relate to civil liability and water sports, which carry their own risks.

Article 1 — Purpose and scope

These General Conditions of Sale govern the contractual relations between [KSE NAME], hereinafter referred to as KSE, company [LEGAL FORM], whose head office is at [ADDRESS], registered under the number [COMMERCE REGISTRY], represented by [LEGAL REPRESENTATIVE], and any natural or legal person reserving a service with KSE.

Any reservation implies full acceptance of these General Terms and Conditions.

Article 2 — Services

KSE offers the following services.

  • Kitesurfing and surfing lessons.
  • Surf trips and kite trips.
  • Equipment rental.
  • Equipment storage.
  • Stay packages combining accommodation, lessons and logistics.
  • Associated services: transfers, advice, organization.

Article 3 — Reservation

3.1 Reservation terms

  • The reservation is confirmed upon receipt of the deposit.

3.2 Deposit

  • Lessons and daily rentals: full payment when booking or on site.
  • Stay packages: 30% deposit upon booking.
  • Balance: 14 days before arrival for packages.

3.3 Payment methods

  • International or local bank transfer.
  • Bank card according to payment provider.
  • Cash in MAD or EUR on site.
  • [Other modes depending on availability].

Article 4 — Prices

Les tarifs sont indiqués en EUR et/ou MAD toutes taxes comprises sauf indication contraire. KSE se réserve le droit de modifier ses tarifs à tout moment, mais applique le tarif en vigueur au moment de la réservation confirmée.

Article 5 — Cancellation and modification

5.1 Cancellation by the Customer

5.2 Modification by the Customer

Toute demande de modification doit être adressée à KSE par email. KSE fait son maximum pour accommoder les demandes mais ne garantit pas la disponibilité.

5.3 Cancellation by KSE

KSE may cancel a service in the event of force majeure, dangerous weather, administrative closure or major technical problem. In this case, a postponement free of charge or a reimbursement of the sums paid for the canceled service is offered.

5.4 No-wind weather policy

  • Report sur une autre journée du séjour si possible.
  • Replacement with another suitable activity, for example surfing in the event of no wind.
  • Reimbursement of the session not carried out if no postponement or replacement is possible.
  • No session is charged if it was not carried out due to unsuitable conditions.

Article 6 — Force majeure

Unforeseeable, irresistible events external to the parties are considered force majeure: natural disasters, armed conflicts, attacks, health restrictions, administrative closures, general strikes. KSE will offer a free postponement or reimbursement of the amounts paid depending on the case.

Article 7 — Required level and prerequisites

  • Beginner kite and surf lessons: no prerequisites except knowing how to swim 25-50 m without difficulty.
  • Kite trips and downwinders: minimum IKO level 4 recommended.
  • Intermediate surf trips: intermediate level required.
  • Kite equipment rental: independent level required.
  • Surf equipment rental: board adapted to the level.
  • KSE may refuse a rental or trip if the level does not correspond to the prerequisites after evaluation.

Article 8 — Safety and liability

8.1 Security

  • Supervise classes by certified instructors according to discipline.
  • Use regularly checked equipment.
  • Carry out a safety briefing before each session.
  • Respect the agreed instructor/student ratios.
  • Adapt the program to the current conditions.

8.2 Customer Responsibility

  • Provide accurate information about their level, health and comfort in the water.
  • Follow the instructors’ instructions.
  • Use the equipment in accordance with its intended use.
  • Report any medical conditions that may affect their safety.

8.3 Limitation of liability

Water sports carry inherent risks linked to nature, weather conditions and sporting activity. The Client acknowledges these risks and agrees to participate in them in full conscience.

Article 9 — Insurance

KSE has professional liability insurance covering damages for which it could be held responsible in the context of its services.

The Customer is strongly encouraged to take out personal multi-sport insurance covering medical expenses, repatriation, cancellation and damage to personal or rented equipment. This insurance is not included in our services.

Article 10 — Rented equipment

  • The Customer reports any observable damage when picking up the equipment.
  • The Customer remains responsible for the equipment for the entire duration of the rental.
  • The equipment must be returned in a condition corresponding to its normal use.
  • Damage resulting from use outside normal conditions may be charged.
  • A deposit is requested when picking up the equipment and returned after verification upon return.

Article 11 — Image rights

During classes and trips, photos and videos can be taken. KSE does not distribute any photo identifying the Client without their explicit consent. The Client may object to any use of his image from the start of the service and request the removal of an image concerning him.

Article 12 — Complaints and dispute resolution

Any complaint must be sent to KSE in writing at contact@kiteandsurfessaouira.com within 30 days following the service. KSE undertakes to provide a response within 15 working days. Failing an amicable agreement, the parties will endeavor to resolve the dispute by mediation before any legal action.

Article 13 — Applicable law and jurisdiction

These General Terms and Conditions are governed by Moroccan law. In the event of a dispute and in the absence of an amicable resolution, the competent courts will be those of [CITY — for example Essaouira or Marrakech]. For Customers resident in the European Union, the mandatory provisions of consumer law in their country of residence remain applicable.

Article 14 — Acceptance

Any reservation with KSE constitutes full acceptance of these General Terms and Conditions. The Customer acknowledges having read the General Terms and Conditions before confirming their reservation.
